Abstract

Human rights start from their very historicity. The book of Genesis is one of the first testimonies of their appearance in the West. It was not until the 20th century, at the end of the Second World War, that the conviction of respect for the rights of each person emerged. With documents such as the Charter of the United Nations, the American Declaration of the Rights and Duties of Man and the Universal Declaration of Human Rights, the so-called internationalization of human rights began. And once they are universalized, they cease to be constitutional rights and become fundamental rights, which are guaranteed for all and are not subject to the availability of the market and politics. It is therefore necessary to resort to praxis in order to reduce the structural distance between normativity and the effectiveness of the guarantees of each individual.
